This book is unique in presenting an interdisciplinary conversation between jurists and logicians. It brings together scholars from both law and philosophy and looks at the application of 'the new logics' to law and legal ordering, in a number of legal systems. The United Kingdom Climate Impacts Programme’s UKCP09 project makes high-resolution projections of the climate out to 2100 by post-processing the outputs of a large-scale global climate model. The aim of this paper is to describe and analyse the methodology used and then urge some caution. Given the acknowledged systematic, shared errors of all current climate models, treating model outputs as decision-relevant projections can be significantly misleading. In extrapolatory situations, such as projections of future climate change, there is little reason to (...) expect that post-processing of model outputs can correct for the consequences of such errors. This casts doubt on our ability, today, to make trustworthy probabilistic projections at high resolution out to the end of the century. (shrink)

This article probes some of the issues The Great War and Modern Memory raises today, whether by Fussell himself, by critics at the time of its original publication, or by rereading the book anew now, in the context of a veritable renaissance in the study of World War I and of the revolution effected by the "literary turn" in historical study. I situate Fussell's book against the backdrop of three foundational works or points of view in cultural history that came (...) to the forefront after 1975. My purpose is not to chide Fussell for failing to anticipate the future directions of the cultural history of war, but rather to show how his work fits into the development of that history.I argue that The Great War and Modern Memory itself became a lieu de mémoire or "site of memory" of the Great War. But like many very successful works, Fussell's book became famous not exclusively or even primarily because of its originality, but because of its ability to reformulate or reinscribe pre-existing ways of understanding. As critic and as veteran, Fussell reasserted the "evidence of experience" as the cornerstone of war writing in the twentieth century. In addition, some of the impact of The Great War and Modern Memory can be explained by the way it supported the most venerable narrative explanation of the Great War, that of tragedy. (shrink)

In recent publications we have drawn attention to the fact that if the dynamics of a model is structurally unstable, then the presence of structural model error places in-principle limits on the model’s ability to generate decision-relevant probability forecasts. Writing with a varying array of co-authors, Eric Winsberg has now produced at least four publications in which he dismisses our points as unfounded; the most recent of these appeared in this journal. In this paper we respond to the arguments of (...) Winsberg and his co-workers, and we point out that their criticisms fail. We take this as an opportunity to restate and explain our arguments, and to point to fruitful directions for future research. (shrink)

Scientific experts have confirmed that anthropogenic warming is underway, and some degree of adaptation is now unavoidable. However, the details of impacts on the scale of climate change at which humans would have to prepare for and adjust to them are still the subject of considerable research, inquiry, and debate. Planning for adaptation requires information on the scale over which human organizations and institutions have authority and capacity, yet the general circulation models lack forecasting skill at these scales, and attempts (...) to “downscale” climate models are still in the early stages of development. Because we do not know what adaptations will be required, we cannot say whether they will be harder or easier—more expensive or less—than emissions control. Whatever improvements in regional predictive capacity may come about in the future, the lack of current predictive capacity on the relevant scale is a strong argument for why we must both control greenhouse gas emissions and prepare to adapt. The sensitive dependence on initial conditions (SDIC) associated with nonlinear models imposes limitations on the models’ predictive power. We draw attention to an additional limitation than has been underappreciated, namely, structural model error (SME). A model has SME if the model dynamics differ from the dynamics in the target system. If a nonlinear model has only the slightest SME, then its ability to generate decision-relevant predictions is compromised. Given a perfect model, we can take the effects of SDIC into account (...) by substituting probabilistic predictions for point predictions. This route is foreclosed in the case of SME, which puts us in a worse epistemic situation than SDIC. (shrink)

Acceptance of elderly or marginal health individuals as kidney donors is debated, with practices varying between centres. Transplant recipients, live kidney donors and health-care professionals caring for patients with renal failure were surveyed regarding their views on live donor kidney transplantation (LDKT) of marginal health (diabetes, hypertension, atherosclerosis, obesity, etc.) and elderly donors. Participants were recruited within a tertiary renal and transplant centre and invited to participate in focus groups and structured interviews. They also completed an anonymous questionnaire. Of 464 (...) participants who completed the questionnaire (36% health-care professionals and 64% patients), 49% and 64%, respectively, stated that marginal and elderly donors should be accepted for LDKT. In the structured interviews, emphasis was given to presenting to donor, recipient and their respective families a calculated risk regarding the effect that either a nephrectomy or transplant has on long-term quality of life. Participants stated that an independent third party in addition to the transplant team should discuss involved risks. Issues of ‘how desperate’ the recipient's situation is should also be considered. Health-care professionals stated that regardless of the strength of will of an individual to donate a kidney (despite age, health problems or personal risk), they should always have the right to say ‘no’ if performing a specific LDKT was against their professional and ethical values. About half of those surveyed considered that marginal health and elderly donors were acceptable for LDKT. Emphasis was given to the explanation to donors and recipients of the risks involved in such transplantation. (shrink)

Jus post Bellum is, like Jus ad Bellum and Jus in Bello, a part of just war theory. Jus post Bellum is distinguished from the other parts of just war theory by being primarily concerned with the principles necessary for securing a just and lasting peace after the end of a war. Traditionally, jus post bellum has focused primarily on three goals: [1] compensating those who have been the victims of unjust aggression, while respecting the rights of the aggressors, [2] (...) punishing and rehabilitating those guilty of war crimes and other violations of the principles of Jus ad Bellum and Jus in Bello and [3] developing measures that will prevent future war and violence (Orend 2000 and May 2012). In this chapter, I outline an account of political forgiveness and explain the role that political forgiveness can have in promoting the goals of jus post bellum. My conception of political forgiveness requires some unpacking. Let me begin with individual forgiveness, which I understand along familiar Butlerian lines as the renunciation of resentment (Butler, Sermon IX in McNaughton 2017: 75-83), though with a bit of a twist. More exactly, ● An individual, I, forgives J for doing F if and only if I renounces all her own warrant for resenting J for doing F. Resentment is a judgment-sensitive attitude, and, therefore, it tends to track judgments concerning its warrant (Scanlon 1998: 20 and Smith 2015). In cases of perfect forgiveness, I’s renunciation causes her to cease feeling resentment toward J for doing F, though, of course, less perfect cases are possible. I reject the idea that there is a sharp discontinuity between individual and political forgiveness, a position argued for by, e.g., Peter Digeser (1998 and 2001). By contrast, I understand political forgiveness as the renunciation of resentment by the relevant political body in question. With greater precision, ● A sovereign political body, P, forgives J for doing F if and only if P renounces all warrant that its citizens have for resenting, as part of their public lives, J for doing F. A little more explanation is in order. Sovereign political bodies, such as national governments, claim degrees of control over the lives of their citizens, in both their public and their private aspects, though the claims with respect to the former tend to be considerably more expansive than the claims with respect to the latter. I assume here that, at least in the case of legitimate governments, these claims of control are often valid. Such governments may reasonably renounce certain grounds for motivating action in the public sphere. For example, governments may renounce all warrant that its citizens have, as part of their public lives, for hating members of marginalized groups. In practice, this means that, while citizens might continue to act in their private lives out of hatred for members of these groups, their appeal to this hatred is seen by the state as irrelevant to matters of law and public policy as well as being wholly out-of-place in public discourse. Political forgiveness toward J for doing F, as I understand it, involves an analogous rejection of resentment, on the part of citizens in their public lives, toward J for doing F. I turn now to the matter of how political forgiveness supports securing a just and lasting peace between former belligerents. With respect to the first goal of jus post bellum, political forgiveness helps to balance compensation for victims and respect for the rights of defeated aggressors by countering the all-too-human tendency to overvalue harms done to oneself and to members of one’s group. As regards the second goal, political forgiveness plays a similar role but also provides a model for rehabilitation by exemplifying among the victorious the behavior to be emulated by the vanquished. Finally, political forgiveness promotes the third goal of jus post bellum by providing a space for nations to meet as moral equals rather than allowing one nation to have the moral high ground over the other. None of this, of course, means that political forgiveness should be unearned or that it should be confused with condonation (Kolnai 1973 and Pettigrove 2004). However, the question of what is required to put oneself in a position to be forgiven as part of jus post bellum is a matter that goes beyond the scope of this chapter. (shrink)

Suppose we are able to transplant Jones's pain centres into Smith's brain. Half way through the operation we test the pain centres by stimulating them electrically in vitro. Would there be pain? Roland Puccetti argues that there would not be. Because pains must have owners and the only available candidate for that role — the excised tissue — is logically unfit to play it. He concludes that the firing of such centres in a normally functioning brain cannot be pain (...) either and that, therefore, materialism is false.So far as I can see, Puccetti's “refutation” is a series of nonsequiturs from start to finish, and that is what I mainly want to show. It will not follow, of course, that materialism is true. Indeed, I think the view which Puccetti attacks under that name is too naive to be taken seriously by anyone. (shrink)
